27/11/2017 - Highlights of 2018 UK Budget

On 22nd November the Chancellor delivered the UK budget which amongst other things proposed radical changes to the taxation of UK immovable property. On 7th November the States of Guernsey will debate the 2018 Guernsey budget. 18/07/2017 - UK tax update on Finance Bill and Trust register

After a period of considerable uncertainty, the UK Government has confirmed that a further Finance Bill will be published as soon as possible after Parliament’s summer recess and in the meantime certain updated clauses have been released including those in relation to deemed domicile and inheritance tax for UK residential property. 09/12/2016 - Finance Bill 2017 Legislation

In line with the Government’s previous pledge to publish the majority of the Finance Bill measures at least three months prior to the Bill being issued, this week saw the release of extensive draft legislation, included in which were further details relating to offshore pensions, the non-dom changes, the taxation of trust income and gains and inheritance tax on UK residential property. The draft legislation remains open for comments until 1 February 2017.

The changes included in the legislation are significant, particularly in relation to offshore trusts. There remain a number of opportunities for tax efficient structuring in order to maximise the advantages provided under the new rules and minimise the tax impact. Those with affected structures should review the position as soon as possible, as should individuals who will become deemed domiciled under the new rules.

Yesterday Philip Hammond delivered his first Autumn Statement which contained, amongst other points, confirmation that the April 2017 changes relating to “non-doms” and inheritance tax for UK residential properties will be going ahead.

26/08/2016 - Reforms to the taxation of non-UK domiciles – issue of consultation document by HM Revenue & Customs

After much anticipation and earlier than expected, HM Revenue & Customs have now issued the “stage 2” consultation document relating to the proposed reforms to the taxation of non-UK domiciles, which follows on from the original proposals announced in the 2015 Summer Budget.

It is clear from the consultation document that the proposals will take effect from 6 April 2017. They have remained broadly in line with the original announcements, albeit with some changes to the detail. Some conciliatory measures have been included, although not the de-enveloping “tax breaks” that were hoped for.

Yesterday's Budget was for the most part fairly benign and included some welcomed reductions in the rates of CGT and corporation tax. By far the most significant for the Channel Islands is the change to the taxation of profits from trading and developing land.
